{"id":21348,"date":"2021-05-15T12:59:25","date_gmt":"2021-05-15T07:29:25","guid":{"rendered":"http:\/\/www.tarshi.net\/inplainspeak\/?p=21348"},"modified":"2021-05-18T17:05:13","modified_gmt":"2021-05-18T11:35:13","slug":"digital-colonisation-redefining-agency-bodily-autonomy-and-being-human","status":"publish","type":"post","link":"https:\/\/www.tarshi.net\/inplainspeak\/digital-colonisation-redefining-agency-bodily-autonomy-and-being-human\/","title":{"rendered":"Is Digital Colonisation Redefining the Understanding of Agency, Bodily Autonomy, and Being Human?"},"content":{"rendered":"<p class=\"BodyA\"><span lang=\"EN-GB\">The launch of the <\/span><span lang=\"EN-US\"><a href=\"https:\/\/ndhm.gov.in\/\" target=\"_blank\" rel=\"noopener\"><span lang=\"EN-GB\">National Digital Health Mission<\/span><\/a><\/span><span class=\"Hyperlink0\"><span lang=\"EN-GB\"> (NDHM<\/span><\/span><span class=\"None\"><span lang=\"EN-GB\">)<\/span><\/span><span class=\"None\"><span lang=\"EN-GB\"> was announced on August 15, 2020. NDHM intends to create a voluntary Unique Health Identifier (UHID) <\/span><\/span><span lang=\"EN-US\"><a href=\"http:\/\/www.egazette.nic.in\/WriteReadData\/2021\/224099.pdf\" target=\"_blank\" rel=\"noopener\"><span class=\"Hyperlink0\"><span lang=\"EN-GB\">based on the voluntary use of Aadhaar<\/span><\/span><\/a><\/span><span class=\"None\"><span lang=\"EN-GB\">.\u00a0 NDHM will maintain health records of a patient\u2019s information that will be \u2018<\/span><\/span><span lang=\"EN-US\"><a href=\"https:\/\/ndhm.gov.in\/\"><span class=\"Hyperlink1\"><span lang=\"EN-GB\">manageable and interoperable with various subsystems<\/span><\/span><\/a><\/span><span class=\"None\"><span lang=\"EN-GB\">\u2019. The pilot of this process <\/span><\/span><span lang=\"EN-US\"><a href=\"https:\/\/www.financialexpress.com\/lifestyle\/health\/health-id-pilot-programme-to-start-with-6-union-territories\/2056613\/\"><span class=\"Hyperlink0\"><span lang=\"EN-GB\">has been launched<\/span><\/span><\/a><\/span><span class=\"None\"><span lang=\"EN-GB\"> in six union territories and will soon also be launched across India. Doctors in Chandigarh <\/span><\/span><span class=\"Hyperlink0\"><span lang=\"EN-GB\">note having <\/span><\/span><span lang=\"EN-US\"><a href=\"https:\/\/caravanmagazine.in\/health\/doctors-in-chandigarh-compelled-to-register-for-the-voluntary-national-health-id\"><span class=\"Hyperlink0\"><span lang=\"EN-GB\">be<\/span><\/span><\/a><a href=\"https:\/\/caravanmagazine.in\/health\/doctors-in-chandigarh-compelled-to-register-for-the-voluntary-national-health-id\"><span class=\"Hyperlink0\"><span lang=\"EN-GB\">en<\/span><\/span><\/a> <a href=\"https:\/\/caravanmagazine.in\/health\/doctors-in-chandigarh-compelled-to-register-for-the-voluntary-national-health-id\"><span lang=\"EN-GB\">\u201ccompelled\u201d<\/span><span lang=\"EN-GB\"> to register<\/span><\/a><\/span><span class=\"None\"><span lang=\"EN-GB\"> for a voluntary UHID with the NDHM. Further, individuals getting vaccinated against COVID-19 are being <\/span><\/span><span lang=\"EN-US\"><a href=\"https:\/\/twitter.com\/anivar\/status\/1384782848327000066?s=20\"><span class=\"Hyperlink0\"><span lang=\"EN-GB\">automatically enrolled for <\/span><\/span><\/a><a href=\"https:\/\/twitter.com\/anivar\/status\/1384782848327000066?s=20\"><span class=\"Hyperlink3\"><span lang=\"EN-GB\">UHID<\/span><\/span><\/a><\/span><span class=\"None\"><span lang=\"EN-GB\"> without their informed consent.<\/span><\/span><\/p>\n<p class=\"BodyA\"><span class=\"None\"><span lang=\"EN-GB\">\u00a0<\/span><\/span><span class=\"None\"><span lang=\"EN-GB\">The NDHM\u2019s strategy document <\/span><\/span><span lang=\"EN-US\"><a href=\"https:\/\/ndhm.gov.in\/documents\/ndhm_strategy_overview\"><span class=\"Hyperlink4\"><span lang=\"EN-GB\">states<\/span><\/span><\/a><\/span><span class=\"None\"><span lang=\"EN-GB\"> the development of privacy by design: \u201cA National Policy on Security of Health Systems and Personal Health Records will be developed in accordance with the Personal Data Protection (PDP) Bill, 2019\u201d. In March 2021, the Joint Parliamentary Committee reviewing the PDP Bill, 2019, <\/span><\/span><span lang=\"EN-US\"><a href=\"https:\/\/thewire.in\/tech\/joint-committee-on-data-protection-bill-gets-fourth-extension-to-submit-report\"><span class=\"Hyperlink4\"><span lang=\"EN-GB\">was given a fourth extension<\/span><\/span><\/a><\/span><span class=\"None\"><span lang=\"EN-GB\"> till the Monsoon session of the Parliament to submit its comments on the Bill. Till the Bill is passed, there is no legal framework to protect anyone\u2019s right to privacy. <\/span><\/span><\/p>\n<p class=\"BodyA\"><span class=\"None\"><span lang=\"EN-GB\">\u00a0<\/span><\/span><span class=\"None\"><b><span lang=\"EN-GB\">Impact of the (in)ability to disclose gender and sexuality in data systems<\/span><\/b><\/span><b><\/b><\/p>\n<p class=\"BodyA\"><span class=\"None\"><span lang=\"EN-GB\">\u00a0<\/span><\/span><span class=\"None\"><span lang=\"EN-GB\">With the global push for the use of a biometric-based digital ID to \u201c<\/span><\/span><span lang=\"EN-US\"><a href=\"https:\/\/www.worldbank.org\/en\/news\/immersive-story\/2019\/08\/14\/inclusive-and-trusted-digital-id-can-unlock-opportunities-for-the-worlds-most-vulnerable\" target=\"_blank\" rel=\"noopener\"><span class=\"Hyperlink1\"><span lang=\"EN-GB\">leave no one behind<\/span><\/span><\/a><\/span><span lang=\"EN-GB\">\u201d<span class=\"None\">, the understanding around identification and citizenship has significantly shifted to mean a person being under the constant surveillance of the State, including details of their gender identity and sexual orientation, among others. Globally, State-based surveillance has seen <\/span><\/span><span lang=\"EN-US\"><a href=\"https:\/\/www.tandfonline.com\/doi\/full\/10.1080\/14754835.2020.1816163\" target=\"_blank\" rel=\"noopener\"><span class=\"Hyperlink0\"><span lang=\"EN-GB\">a significant rise during the COVID-19 pandemic<\/span><\/span><\/a><\/span><span class=\"None\"><span lang=\"EN-GB\">, consequently redefining the global understanding of agency, consent and bodily autonomy.<\/span><\/span><span class=\"None\"><span lang=\"EN-GB\">\u00a0<\/span><\/span><\/p>\n<p class=\"BodyA\"><span class=\"None\"><span lang=\"EN-GB\">Women who cannot <\/span><\/span><span lang=\"EN-US\"><a href=\"https:\/\/wcd.nic.in\/sites\/default\/files\/PMMVY%252520Scheme%252520Implemetation%252520Guidelines%252520._0.pdf\" target=\"_blank\" rel=\"noopener\"><span class=\"Hyperlink0\"><span lang=\"EN-GB\">produce <\/span><\/span><\/a><span class=\"Hyperlink0\"><span lang=\"EN-GB\">the<\/span><\/span><\/span><span class=\"Hyperlink0\"><span lang=\"EN-GB\">ir own and their husband\u2019s<\/span><\/span> <span class=\"Hyperlink2\"><span lang=\"EN-GB\">Aadhaar<\/span><\/span> <span lang=\"EN-US\"><a href=\"https:\/\/scroll.in\/pulse\/945587\/how-aadhaar-is-making-it-harder-for-indian-women-to-access-their-maternity-benefits\" target=\"_blank\" rel=\"noopener\"><span class=\"Hyperlink0\"><span lang=\"EN-GB\">cannot access maternal benefits<\/span><\/span><\/a><\/span><span class=\"None\"><span lang=\"EN-GB\">. Accessing abortion services in the public healthcare system without an Aadhaar <\/span><\/span><span lang=\"EN-US\"><a href=\"https:\/\/thewire.in\/government\/activists-slam-mandatory-linking-aadhaar-health-services-woman-denied-abortion\" target=\"_blank\" rel=\"noopener\"><span class=\"Hyperlink0\"><span lang=\"EN-GB\">is not possible<\/span><\/span><\/a><\/span><span class=\"None\"><span lang=\"EN-GB\">. According to the new law, transgender persons are expected to produce a medical certificate to be able to self-identify their gender within the binary on their IDs including Aadhaar. Mandatory use of Aadhaar for a life-affirming treatment like Anti-Retroviral Treatment (ART) has resulted in individuals discontinuing their treatment fearing a breach of their privacy. In the current wave of the pandemic, even <\/span><\/span><span lang=\"EN-US\"><a href=\"https:\/\/twitter.com\/logic\/status\/1386326573217771521?s=20\" target=\"_blank\" rel=\"noopener\"><span class=\"Hyperlink0\"><span lang=\"EN-GB\">procuring oxygen<\/span><\/span><\/a><\/span><span class=\"None\"><span lang=\"EN-GB\"> requires Aadhaar! <\/span><\/span><\/p>\n<p class=\"BodyA\"><span class=\"None\"><span lang=\"EN-GB\">Evidently, in the present digital framework, the human rights guaranteed by the Constitution of India become relevant and available only if individuals are able to turn themselves into neat (and perfect) categories of data \u2013 cisgender, heterosexual, able-bodied, married (and remaining married), among others, through the use of a 12-digit number and biometrics such as finger prints, iris scan, and <\/span><\/span><span lang=\"EN-US\"><a href=\"https:\/\/thewire.in\/rights\/covid-19-vaccination-facial-recognition-technology-aadhaar-vaccine\" target=\"_blank\" rel=\"noopener\"><span lang=\"EN-GB\">facial recognition<\/span><\/a><\/span><span class=\"Hyperlink0\"><span lang=\"EN-GB\"> (the most recent addition)<\/span><\/span><span class=\"None\"><span lang=\"EN-GB\">. There\u2019s also a <\/span><\/span><span lang=\"EN-US\"><a href=\"https:\/\/indianexpress.com\/article\/india\/dna-bill-parliament-7173639\/\" target=\"_blank\" rel=\"noopener\"><span class=\"Hyperlink0\"><span lang=\"EN-GB\">DNA <\/span><\/span><\/a><a href=\"https:\/\/indianexpress.com\/article\/india\/dna-bill-parliament-7173639\/\"><span class=\"Hyperlink0\"><span lang=\"EN-GB\">B<\/span><\/span><\/a><a href=\"https:\/\/indianexpress.com\/article\/india\/dna-bill-parliament-7173639\/\"><span class=\"Hyperlink0\"><span lang=\"EN-GB\">ill<\/span><\/span><\/a><\/span><span class=\"None\"><span lang=\"EN-GB\"> in the works! This list also seems to include information related to one\u2019s sexuality and gender. The inability to turn different parts of one\u2019s self into data, ironically with an instrument introduced to fulfil constitutional guarantees, has resulted in a whole range of exclusions for gender and sexual minorities<\/span><\/span><a title=\"\" href=\"applewebdata:\/\/8BCDEB0A-2F72-47B2-9B18-3CCCE99BB14F#_edn1\" target=\"_blank\" rel=\"noopener\" name=\"_ednref1\"><span class=\"None\"><sup><span lang=\"EN-GB\">[1]<\/span><\/sup><\/span><\/a><span class=\"None\"><span lang=\"EN-GB\">. Contrary to constitutional guarantees, these exclusions become far higher and more complex due to the existing marginalisation owing to an individual\u2019s caste, class, religion, educational qualification, and so on. <\/span><\/span><\/p>\n<p class=\"BodyA\"><span class=\"None\"><span lang=\"EN-GB\">Apart from systematic exclusions faced by individuals, evidently the mandatory use of a biometric-based digital ID has also reshaped the understanding of an individual\u2019s agency and right to bodily autonomy. Gender and sexuality seem to no longer be matters of an individual\u2019s right to privacy. With digitisation, disclosure of one\u2019s gender and sexuality has become a hindrance to accessing one\u2019s rights. However, the inability to disclose such details would also mean exclusion. In a country where anything related to sexuality is considered taboo, it becomes an additional burden when individuals are forced to reveal details related to their gender identity and\/or sexuality to gain access to their rights.<\/span><\/span><span class=\"None\"><span lang=\"EN-GB\">\u00a0<\/span><\/span><\/p>\n<p class=\"BodyA\"><span class=\"None\"><b><span lang=\"EN-GB\">Redefining the meaning of agency and bodily autonomy<\/span><\/b><\/span><b><\/b><\/p>\n<p class=\"BodyA\"><span class=\"None\"><span lang=\"EN-GB\">The use of a digital ID to authenticate the use of a public health service also tracks the individual\u2019s personal terms of engagement with another consenting adult \u2013 as seen with single mothers, cis women accessing abortion services and with the professional agency exercised by sex workers \u2013 in order to access essential SRHR services. This also implies the conscious dismissal of or the erasure of the right to privacy for individuals belonging to gender and sexual minorities. Presently, as there is no legal framework to protect an individual\u2019s right to privacy in India, there is no assured protection or recourse against any breach of privacy. Besides, the constant vacillation between voluntary and mandatory use of Aadhaar over the last several years \u2013 even prior to the <\/span><\/span><span lang=\"EN-US\"><a href=\"https:\/\/www.scobserver.in\/court-case\/constitutionality-of-aadhaar-act\" target=\"_blank\" rel=\"noopener\"><span class=\"Hyperlink5\"><span lang=\"EN-GB\">Supreme Court verdict<\/span><\/span><\/a><\/span><span class=\"None\"><span lang=\"EN-GB\"> that upheld the constitutionality of the Aadhaar Act \u2013 has gradually changed the general understanding of consent. Mandating the use of Aadhaar to access welfare, inspite of exclusions, further emphasises the changing understanding of consent. We don\u2019t really have a choice! Changing our understanding of consent over time is a subtle way of redefining our understanding of individual agency. The \u2018voluntary\u2019 use of Aadhaar without informed consent to create a digital health ID is yet another example of the same.<\/span><\/span><\/p>\n<p class=\"BodyA\"><span class=\"None\"><span lang=\"EN-GB\">In digital systems, the disclosure of an individual\u2019s gender identity and sexuality seems to be essential to access all public and private services, well beyond SRHR services, by using a government-issued ID. Digital data implies interoperability across multiple devices, formats, and locations. The inability to comply with such exposure of oneself due to various reasons beyond one\u2019s control such as exclusionary design, authentication failures, access to Internet, marginalisation, and so on, seems to mean exclusion. This is an inherent flaw with digitising offline systems without rectifying the existing structural problems. Yet, the ability to codify oneself into different data systems also does not guarantee inclusion and access to sexual and reproductive health and rights, or any other right for that matter. However, such exposure does increase one\u2019s vulnerability to data breaches, especially without a legal framework for protection. The <\/span><\/span><span lang=\"EN-US\"><a href=\"https:\/\/www.businessinsider.in\/tech\/news\/bhim-app-left-aadhaar-cards-pan-numbers-and-biometric-information-exposed\/articleshow\/76135419.cms\" target=\"_blank\" rel=\"noopener\"><span class=\"Hyperlink0\"><span lang=\"EN-GB\">data breach on CSC Bhim site <\/span><\/span><\/a><\/span><span class=\"None\"><span lang=\"EN-GB\">in 2020 included information such as Aadhaar details, addresses, bank records, caste certificates, and a complete personal profile of the users\u2019 biometrics, among others. The current version of the PDP Bill <\/span><\/span><span lang=\"EN-US\"><a href=\"https:\/\/www.medianama.com\/2021\/04\/223-we-need-to-know\/\" target=\"_blank\" rel=\"noopener\"><span class=\"Hyperlink0\"><span lang=\"EN-GB\">has no provision to inform individuals<\/span><\/span><\/a><\/span><span class=\"None\"><span lang=\"EN-GB\"> in case their data is breached.<\/span><\/span><\/p>\n<p class=\"BodyA\"><span class=\"None\"><span lang=\"EN-GB\">Evidently, mandatory use of a digital ID, data breaches, and the continued exclusions then significantly reshape the understanding of an individual\u2019s agency, right to bodily autonomy, and consent, especially for gender and sexual minorities owing to the historical marginalisation faced by them. <\/span><\/span><\/p>\n<p class=\"BodyA\"><span class=\"None\"><b><span lang=\"EN-GB\">Shaping reality using bad (exclusionary) data sets = Erasure! <\/span><\/b><\/span><b><\/b><\/p>\n<p class=\"BodyA\"><span class=\"None\"><span lang=\"EN-GB\">The insistence on using data to make welfare decisions, including access to healthcare, has the potential to hardcode existing offline biases into digital data systems due to the biased datasets that are fed into Automated Decision Making Systems (ADMS) that use Artificial Intelligence (AI) and Machine Learning.<\/span><\/span><span class=\"None\"><span lang=\"EN-GB\">\u00a0<\/span><\/span><\/p>\n<p class=\"BodyA\"><span class=\"None\"><span lang=\"EN-GB\">This also includes datasets that impact sexual and reproductive health and rights related services. The continued inability of individuals to enter data systems <\/span><\/span><span lang=\"EN-US\"><a href=\"https:\/\/www.indiatoday.in\/technology\/news\/story\/aadhaar-is-mass-surveillance-system-will-lead-to-civil-death-for-indians-edward-snowden-1319121-2018-08-20\" target=\"_blank\" rel=\"noopener\"><span class=\"Hyperlink0\"><span lang=\"EN-GB\">will lead to their civil death<\/span><\/span><\/a><\/span><span class=\"None\"><span lang=\"EN-GB\">, and with a diminishing dataset of a particular identity, might even lead to the erasure of a whole population group over time.<\/span><\/span><\/p>\n<p class=\"BodyA\"><span class=\"None\"><span lang=\"EN-GB\">\u00a0<\/span><\/span><span class=\"None\"><span lang=\"EN-GB\">With the constantly changing understanding of consent in addition to the existing marginalisation, individuals don\u2019t have any real control over the data collected from them or the use of this data, especially in the absence of a regulatory legal framework. From apps to IDs, from private players to the State, everyone wants a piece of your data. The understanding of agency and autonomy is likely to further devolve when ADMS will determine the ability of an individual to access healthcare using algorithms. How will certain highly sensitive details such as HIV status, number of abortions undergone, or gender identity play a role in determining the eligibility of a person to access insurance services and healthcare? How will this access be further shaped by other data such as caste or religion or disability status, factors historically used to discriminate against and marginalise individuals? What is the morality being used to shape the understanding of these systems? Is it the morality of a cisgendered heterosexual reality that is being used to shape the algorithm of these systems? What about the rest who don\u2019t fit into that paradigm? What is the interpretation of the \u2018reality\u2019 that we are allowed to exist within?
